Illinois Felony Defense Attorneys
If you are charged with a felony in Illinois, your life as you know it is essentially on the line. Finding the right attorney can be the difference between freedom and years in jail with a record that is ruined. Unfortunately, there is no simple formula to help you choose the perfect attorney. There is no such thing as the "best felony defense lawyer in Illinois.” It’s just not that easy. You need to find the best attorney for the situation you are facing.
If you have been charged with a felony, your goal should be to avoid jail time and/or have it reduced to a misdemeanor. Since felonies cannot be expunged or sealed (unless it is a Class 4 drug felony), all felonies are available to be viewed by future employers and the public. Of course, if you are innocent of the charges your goal should be a complete dismissal of the case or a not guilty finding at trial.
There are varying classes of felonies. The lowest level felony in Illinois is a Class 4 felony. The most serious felony in Illinois is a Class X.
Felonies in Illinois can be violent crimes such as murder, rape, and kidnapping. But a violation of state drug laws and a theft (of a value more than $300) is also a felony. Other felonies include arson, possession of child pornography, intimidation, stalking, failure to register as a sex offender, solicitation of murder for hire, bribery and forgery.
To be certain, defending a felony in Illinois is much more complicated than defending a typical misdemeanor. It often involves numerous court appearances, significant investigation by your lawyer, and lots of work. While many Judges and prosecutors will routinely dismiss misdemeanor charges, if you are charged with a felony they are often seeking jail time.
In our opinion it is vital that you hire a lawyer that focuses their practice on criminal defense and has defended hundreds of felonies in the past. Your attorney needs to have significant experience with felonies and know all the ins and outs of the procedure.
You typically also want to hire a lawyer that does a lot of work at the court where you are being charged. A good relationship with the prosecutor and/or Judge can often be the determining factor in getting a case reduced to a misdemeanor or dismissed. In one case that we were involved with, a criminal defendant was being offered a 12 year jail sentence through his lawyer. He called us for a second opinion and we were able to connect him with a lawyer that used to be a prosecutor in the courtroom where the charges were filed. He knew the current prosecutor and got them to change the deal from 12 years in jail to one. While it was still prison time, for a serious drug crime it was a great result and was all based on relationships.
In understanding how a felony case is handled, it is also important to recognize how the facts of each individual case can increase the level (and thus the potential punishment) of a felony.
Certain circumstances of the crime, or aggravating factors, may increase the level of the felony. For instance, robbery is a Class 2 felony. However, if the victim was over the age of 60 or physically handicapped, or if the crime took place in a school or place of worship, it is raised to a Class 1 felony.
With drug charges, for example, possession of 2,000 grams but less than 5,000 grams of marijuana is a Class 2 felony. However, possession of 30 grams of marijuana but less than 500 grams is a lesser Class 4 felony. Unlike other felonies, Class 4 drug felonies can be expunged or sealed.
Certain civil rights can also be lost with the conviction of a felony, including voting, owning a weapon and even driving.
As you can see, who you retain to defend you in a felony case is a very important decision.
