If a person’s spouse, parent, or loved one passed away and had a life insurance policy, that person will contact the life insurance company to request the benefits. In some cases they will pay out the benefit as they are supposed to. In some cases, the life insurance company will rightfully deny the claim and not make a payout. Reasons for denying the claim include failure to disclose a medical condition, the life insurance premiums were not paid, or the deceased outlived the policy’s term (if it was a term life insurance policy).

However, in many cases, life insurance companies unjustly deny the claim for benefits. This is incredibly frustrating for a person who is grieving a loved one’s death. Dealing with an insurance company is not easy, and often the jargon they use is complex and difficult to understand. They do this because they think they can get away with it. If they wrongly deny a payout and you go away, it saves them a lot of money. That’s essentially the business model of these companies.

So what should a person who thinks a life insurance payout has been wrongly denied do?

Our advice is to contact us so we can understand your situation and refer you to an experienced and reputable lawyer who can take on the insurance company for you and secure the benefits if you are entitled to them.

A lawyer with a track record of success in these cases will file a lawsuit against the life insurance company almost immediately. This will force the life insurance company to respond and will help determine if they truly have a valid reason for not paying.

This type of lawsuit is pretty straightforward and usually solves the problem. In fact, in our experience, disputed life insurance cases get resolved faster than any other type of claim out there because the case issues are usually really narrow and there isn’t often a need for a lot of witness testimony as compared to other cases.

One important aspect to note in life insurance cases is that lawyers are paid on a contingency basis. That means that you do not have to pay the lawyer by the hour or anything up front. The lawyer will start the case, file the lawsuit, and do the work in exchange for a contingency fee. The contingency fee in life insurance cases is typically 1/3 of the payout. If the attorney is unsuccessful in obtaining benefits from the loved one’s insurance policy, then they get paid nothing.

We can usually tell pretty quickly if you have a good case or not. If you’d like a free consultation with an attorney, please contact us any time. We help everywhere in Illinois with disputed life insurance payout claims.
