An ATV (all terrain vehicle) is designed for fun. It’s generally not like a car where you’d use it every day. It’s meant for off-roading, riding through fields, and having a good time. There are different types of ATV’s. A sport ATV is meant for speed and recreational activities. A utility ATV can be for fun, but is also used during work as it is helpful in hauling items. There are even youth ATV’s which are meant for smaller riders. Some ATV’s are meant for one person. Others have straddle seats for a passenger like you might see on a motorcycle.
Of course accidents happen a lot on ATV’s. If someone else is negligent, you likely have a lawsuit if you are injured. Unlike many car accident cases, that can be true even if you were the only vehicle involved. Some examples of ATV lawsuits include:
- Suing the driver if you were injured as a passenger when they drove recklessly.
- Suing the landowner where you got hurt if the property was dangerous or had hidden defects.
- Going after other drivers if they caused the accident.
- Suing the ATV owner if they were negligent in letting a young, untrained person drive without assistance.
- A lawsuit against the ATV manufacturer if a design flaw caused the accident (this would likely require major injuries as these are expensive lawsuits).
- Suing ATV rental companies for not providing safe riding instructions or giving you an unsafe vehicle.
Since ATV’s lack seatbelts, doors, airbags and other protections, when we get called about an ATV injury in Illinois, the injuries are usually very serious. Some injuries we have seen include:
- Traumatic brain injuries or TBI’s from hitting your head.
- Spinal cord injuries with paralyzation being the worst result.
- Broken bones over various body parts with broken legs being very common.
- Shoulder and arm injuries from trying to brace yourself from being thrown from the vehicle.
- Internal injuries.
While any personal injury attorney could handle an ATV accident lawsuit, because the unique nature of these claims, we think it is highly important that you get someone who has handled them successfully on prior cases to represent you. It can literally be the difference between winning and losing the case as well as hundreds of thousands of dollars or more in what the case is worth. Illinois actually has a special ATV law that your attorney should be familiar with. It includes responsibilities for landowners, insurance information and requirements as well as safety specifications for the vehicle itself.
You are eligible to recover economic damages such as lost wages, property damage and medical bills. You also can get non-economic damages which generally speaking is pain and suffering, emotional distress and loss of enjoyment of life. If you were injured while working and an ATV was involved, you likely also would be able to receive workers’ compensation benefits.
